Ocampo Dismisses Appeal by Kenyan Four

The Prosecutor of the International Criminal Court (ICC) Luis Moreno-Ocampo has dismissed requests made by the Kenyan suspects of the 2007 post-election violence to be given permission to appeal the decision confirming their cases.
The four suspects currently facing counts of international crimes include Kenya’s Deputy Prime Minister and Minister of Finance Uhuru Kenyatta, Head of Civil Service Francis Muthaura, radio journalist Joshua Arap Sang and Former Higher Education Minister William Ruto.
The suspects appealed in accordance with the Rules of Procedure and Evidence of Article 82(1)(d) of the Rome Statute on the basis that the pre-trial judges had given more credibility to the prosecution’s witnesses and evidence.
Mr. Moreno-Ocampo dismissed these claims on the basis that such issues were not "appealable issues arising from the decision" and that their arguments were more statements of disagreements with the judges and Prosecutor, rather than the defence’s rebuttal to the claims against them.
Please note that the UCICC uses the official case name found on the ICC website, which currently lists former Police Commissioner Mohammed Hussein Ali and Former Cabinet Minister Henry Kosgey as suspects despite charges being dropped on January 23rd, 2012.
